ABUSE OF LAW FROM THE CIVIL LAW AND LABOR LAW POSITIONS

Abstract

The article is devoted to specific issues of abuse of law from the standpoint of civil law and labor law. It is established that civil law allows to interpret the abuse of law as an offense, while labor law under the abuse of the law means an independent type of legal behavior that does not fall under the signs of a wrongful act. Specific to civil and labor law are the legal consequences applicable to acts that are abusive. The Civil Code of the Russian Federation establishes as such a refusal to protect the rights, damages, and other measures. The labor code of the Russian Federation does not provide any legal consequences.
