PECULIARITIES OF COLLECTING EXECUTIVE FEES FROM JOINT DEBTORS

Abstract

The article is devoted to the institution of the executive fee, which is the responsibility
for the debtor in the enforcement proceedings for failure to comply with the requirements
of the executive document on a voluntary basis. For joint debtors on executive
proceedings instituted in favor of one recoverer, p. 3.1. Article 129 of the Federal Law
"On Enforcement Proceedings" provides for the amount of the executive fee in the
amount of seven percent of the amount to be recovered or the value of the recovered 

property. The executive fee is a sanction of administrative penalty for the offense committed
by the debtor, is designed to ensure the individual liability of the debtor in the enforcement
proceedings, in this connection, the article considers the proposal to collect the
executive fee from each of the joint debtors, not limited to the total amount.
