UNIVERSALITY AS A PROPERTY OF LEGAL PRINCIPLES
Abstract
The article investigates the problem of universality of legal principles based on the
analysis of the concept of principles of law and their basic properties, the following questions
are examined: to what extent the principles of law are objective, and what are the
criteria for giving legal status to the ideas of principles of law, whether legislative design
of principles is their attribute or due to the understanding of the "spirit" but not the "letter"
of the law, they do not need such consolidation, and finally, to what extent the principles
of law are conditioned by the historical continuity of legal regulation. The authors analyze
the basic properties of law principles, allowing to consider them as the universal flexible
means which are capable to correlate changes in objective law with the basic law, with its
primary ideological component, and to provide a balance between objective and subjective
law.
