Abstract

The article explores the concept of criminal procedure, its basic properties. The points of view on the structure of criminal procedural activity are considered. The author substantiates her concept of the structure of criminal procedural activity and its elements, which determine the qualitative specifics of the criminal process.

It is concluded that the criminal procedural functions are integral aspects of criminal procedure and form its structure. Between the functions of the criminal proceedings there is a strong relationship that delivers the value of the criminal proceedings, the preservation of its purpose, its essence. Only the interaction of all criminal procedural functions makes it possible to establish the circumstances relevant to the criminal case and to make a legitimate and justified conclusion about the guilt or innocence of the person brought to criminal responsibility.
