INFORMATION THAT CONSTITUTES AN OFFICIAL SECRET

Abstract

his article analyzes the various approaches to the definition of terms of information,
access to which may be restricted to professional secrecy mode, as well as analysis of
various departmental list of information constituting the official secret or confidential
information. The analysis of the two models restrict access to information implemented in
the right state regulation tie us and the legal regime of a trade secret as the mandatory and
discretionary model. Argued the inadmissibility of the restriction of access to information
held by public authorities in general, as provided for by the Federal Law «About public
service». The author makes a conclusion about the necessity of legislative consolidation
of a single list of data which may be official secret for streamlining information, the possibility
of introducing sanctions for violations of the protection and observance of human
rights to information. Also, the paper gives a detailed classification of information, access
to which is limited mostly by public authorities and concluded that according to incomplete
lists of federal legislation requirements.
