THE MECHANISM OF INFLUENCE OF CONSTITUTIONAL VALUES ON THE LEGITIMATE BEHAVIOR OF THE SUBJECTS OF CONSTITUTIONAL AND LEGAL RELATIONS

Abstract

The article deals with peculiarities of the impact of constitutional values on the lawful
conduct of subjects of constitutional and legal relations. According to the author, the mechanism
of such influence includes a number of elements, the list of which can not be defined
completely, but constitutional legal consciousness and legal awareness can be classified as its main components. The environment where the activity of the considered mechanism is conducted is the legal culture. The condition of effective influence on the behavior of a particular constitutional value is its invariability for a long time. The author justifies the point that the constitutional lawful behavior of the collegial legal entities (social communities and the society as a whole) is only possible in case of a unified understanding of any value as a guideline and a means of realization of the constitutional model, its practical use. This specified effect should be reached by forming the legal ideology, which enables one to combine constitutional values as an integrated system, avoid their mechanistic fragmentary perception, and ensure the constitutionality of a conceptual approach to understanding of their nature, taking into account the dynamics of social and economic development.
