THE OPTIONS OF INTRODUCING THE INSTITUTION OF THE INVESTIGATING JUDGE IN PRE-TRIAL CRIMINAL PROCEEDING

Abstract

This paper concentrates on the various options of introducing the institution of the investigating
judge in pre-trial criminal proceedings. The author justifies his vision of the organization
of judicial control and powers of the investigating judge in the pre-trial stages of the criminal
process. The draft legislative regulation of depositing the evidence by the investigating
judge is considered as a separate issue. The author develops the idea of the Nizhny Novgorod
school of processualists concerning the reform of the preliminary investigation and the legal
relationship system between the investigating judge and the parties.
