METHODOLOGICAL ISSUES OF THE STUDY OF IMBALANCE PHENOMENON IN LEGISLATION

Abstract

The article is devoted to the most topical issues of methodological bases of legislative imbalance
cognition as a comprehensive legal phenomenon. The author identifies a number of
methodological principles, taken from the general system theory, which allows us to build the
most complete and adequate theoretical model of imbalance in law as a dynamic process. The
relationship of such concepts as legislative balance, legislative imbalance, defective legislation
is revealed. Attention is drawn to the integrating nature of the concept of “legislative imbalance”,
which is expressed in the synthesis by means of a number of opposite characteristics and
trends in the development of legislation –consistence (stability) and variability (instability),
equality and inequality, proportion and disproportion, consistency and coherence, etc.
