TO THE QUESTION OF DEVELOPMENT OF THE CIVIL CIRCULATION PARTICIPANTS SYSTEM

Abstract

On the basis of the concepts "legal status", "legal personality", "features of legal subject"
the possibility of expansion of a circle of civil circulation participants at the expense
of bodies of legal entity, sessions and transnational corporations is considered. Novels of
legislation, court practice and doctrinal literature are analyzed, the lack of legal regulation
is revealed. The asynchrony of development of substantive and procedural law concerning
quasi - legal personality of bodies of legal entity is stated. It is proved that bodies of
legal entity do not comply with all features of legal subject. On the basis of the analysis
of public and private law sources five major meanings in which the term "session" is used
are revealed, the most significant of them are – actions (meetings) and legal personality
entities. Official characteristics of transnational corporations are systematized, the main
directions of its doctrinal research and development of legislation on this matter are offered:
definition of transnational corporation, its legal status and legal personality.
