THE PROCEDURAL STATUS OF THE PERSON AGAINST WHOM STATE PROSECUTION IS PERFORMED
Abstract
The article analyzes scientific discussions on optimization of the procedural status of
person subjected to criminal prosecution and against whom state case is formed. Appropriate
terminology which is used in international legal acts and in foreign legislation is considered.
The conventionality of the usage of any legal terms and the priority of the substantive meaning
and human rights in law in comparison to their formal expression is emphasized.
