Abstract

The article is devoted to the history of the methodological foundations of the history
of state and law. Specific historical patterns of development of state and law have
their specificity compared with the laws of social development for the state and law
occupies a special position, and is relatively independent. Great importance for the
analysis of used historical and legal processes is played by a historical context in which
research is conducted. Political and ideological factors are decisive. However, the main
trend of recent years has been the denial of the ideological function of the state in connection
with the denial of many progressive achievements of the Soviet science based
solely on ideological principles. Therefore it is important to study the methodology of
history of state and law.
