LEGAL AND PROCEDURAL ASPECTS OF PREVENTION OF CRIMES IN TERMS OF EMERGENCY SITUATIONS

Abstract

Under conditions of development of modern constitutional state the
problems of protection of its citizens from criminal offences, and also
counteraction to attempts of criminalization of society, neutralization of
negative social tendencies are of a primary importance. Law enforcement
agencies have to pay much attention to protection of the rights and
freedoms of the person, his legitimate interests. It is necessary to provide
measures for their full implementation. In this context special attention is
paid to struggle against crime, preventive activity in particular, and it is not
a secret that nowadays these systems are under structuring in this difficult
period.
In this article the author considers a preventive role of bodies of
preliminary investigation of criminal cases committed in emergency
situations. The article represents the author's view of the reasons and
conditions promoting commission of crimes (mass riots, armed attacks on
officials, etc.), other factors which have aggravated a course of events, etc.
The author gives a number of the actions realization of which can affect a
positive result of conflict resolution in a competent way, suppression of
criminal acts, etc.
