LOCAL LEVEL OF LEGAL REGULATION ON THE BASIS OF LOCAL TECHNICAL NORMS

Abstract

The article is devoted to the peculiarities of the local level of legal regulation.
Specificity of local norms depends of their scope. Corporate relations are
qualitatively heterogeneous and depend on the characteristics of a particular
organization. However, all local legal rules have universal characteristics,
which caused by their place in the legal system. On the example of local technical
and legal norms the authors show features of the objects and actions in
terms of a number of people of this kind of rules. Local technical and legal
norms are separated in the group not on the branch but on the functional and
substantive basis. Their characteristic is necessary to justify the regulatory
and legal nature of local norms, as a part of the mechanism of legal regulation.
Being a tool for organizing the processes within the economic entity, the
local technical and legal rules carry a regulatory function in respect of persons
having relatively legal relations with the subject, and their implementation
is justified by the power of public enforcement. Based on these arguments,
the authors come to the conclusion that there is the necessity to nontraditional
approach, which limits the value and role of local norms by the
specification of the provisions of law in relation to the respect of personalized
public.
