JUDICIAL CONTROL AS A FORM OF LEGISLATION CONSTITUTIONALIZATION

Abstract

The article deals with judicial norms control as a means of resolving contradictions
in the legal system of the state from the perspective of its impact on
the constitutionalization of the domestic legislation. During the trial Normcontrol
manifested special nature of judicial decisions in such disputes, which is
reflected in an adjustment to embed legislation consistent legal system. In addition,the formation of a new entity to resolve legal conflicts – the Supreme
Court of the Russian Federation indicates the need to develop appropriate constitutional and legal approaches, unambiguous and understandable to judges
and stakeholders criteria of separation of powers of courts to verify the constitutionality of normative legal acts.
