DISCRIMINATION ON DISABILITY GROUNDS IN LABOUR RELATIONS
Abstract
The article analyzes the state of the normative framework regulating
the issues of employment of persons with disabilities, special attention is given
to the provisions regulating the activity of the Federal body of medical
and social assessment. On the basis of the analysis there are the following
conclusions: the concept of «disability» contradicts the Russian Constitution
and international law, the reason for this contradiction is the consideration
of «disability» only from the medical point of view, social factors are overlooked;
in the relationship between an employee, an employer and the Federal
body of medical and social assessment there is a problem of the hermeneutic
nature concerning the understanding of the specially created working
conditions.
