INHERITANCE OF INTELLECTUAL PROPERTY RIGHTS

Abstract

The article deals with inheritance of intellectual property rights in
the Russian civil law. The author highlights the problem of inheritance
of certain categories of intellectual property rights: the exclusive right,
moral rights and other intellectual property rights. Features of definition
of "exclusive rights" in modern civil law are considered. Then the
author differentiates between inherited and non-inherited intellectual
property rights. Within the article the problem of inclusion of obligatory
rights of the authors-testators in heritage is analyzed.
