IMPLEMENTATION OF THE PRINCIPLE OF JUSTICE IN THE NORMS OF THE ADMINISTRATIVE PRECEDENT

Abstract

The article is devoted to realization of the principle of justice in the norms
of the administrative precedent. At present at the implementation of the provisions
with administrative precedent (in particular Article 151. 1 of the Criminal
Code), there is a paradoxical situation. It is connected with the fact that the
penalty for repeated sale of alcohol to a minor is appointed less than it should
have been for the first time. For the first administrative offence, the person is
punished more , than for further violation, which is the violation of the principle
of justice.
