APPLICATION OF CRIMINAL PENALTIES AS A CRITERION FOR ITS EFFECTIVENESS

Abstract

One of the criteria of the effectiveness of criminal penalties is the frequency
of penalty imposition for the commitment of specific criminal acts.
Frequent use of criminal punishment allows us to realize its punitive, repressive
potential given by the legislator. The article considers the quantitative
characteristics of applicability of all types of criminal penalties depending
on the category of crime, thus, the effectiveness of criminal penalties by
crime categories is evaluated. The author comes to the conclusion that the
applicability of punishment in the form of deprivation of the right to hold
certain positions or practise certain activities is extremely low, and in respect
of all crime categories the specified punishment is ineffective, and its
repressive, punitive potential remains unfulfilled to achieve the objectives of
criminal punishment
