Abstract

Analyzing the norms of the Criminal procedure code of the Russian Federation and practice of their application the author comes to the conclusion that participation of a counsel for the defence at realization of provisions of Chapter 40.1 of the Criminal procedure code of the Russian Federation in criminal proceedings is one of essential guarantees to defense the rights of the suspects (the accused) as well as the provision of law and justice of the sentence.

    was born on September 9, 1988. In 2010 she graduated from Smolensk University for Humanities. Now she is a senior lecturer of Criminal Law and Procedure Department of Smolensk University for Humanities. She is the author of 34 publications. Research interests: criminal law, criminal procedure.
