GOVERNMENT AS PUBLIC SUBJECT OF LEGAL RELATIONSHIP WITH PARTICIPATION OF CITIZENS, VICTIMS OF TECHNOGENIC CATASTROPHES

Abstract

In the article the problems connected with participation of the government in legal relationship, resulted from large technogenic catastrophes, including, those of radiation character are analyzed. The mechanism of realization of compensation of harm has to be considered through a prism of a constitutional law according to which the government as the public subject bears responsibility for infliction of harm to citizens, victims of technogenic catastrophes. Technogenic catastrophes have to be considered as circumstance of emergence of two groups of legal relationship with the participation of the government. Firstly, the government compensates the harm done to citizens. Secondly, the government acts as the subject that provides social security and social protection of injured citizens.
