JUDICIAL LEGAL POSITIONS OF THE CONSTITUTIONAL COURT OF THE RUSSIAN FEDERATION AND THE SUPREME COURT OF THE RUSSIAN FEDERATION AS A SOURCE OF CRIMINAL PROCEDURAL LAW
Abstract
The article is devoted to the legal nature of court legal positions of the Constitutional Court of the Russian Federation and of the Supreme Court of the Russian Federation. The main types of law sources in modern legal systems are considered. The author has carried out a comparative analysis of the main features of the regulatory legal act and the judicial legal positions. The author’s own concept of the court legal position is formulated. The author comes to the conclusion that the judicial legal position, contained in the decisions of the Constitutional Court of the Russian Federation and the decisions of the Supreme Court of the Russian Federation, have all the features of a normative legal act.
