Abstract

The article analyzes the legal unsettledness of the issue of dismissal of employees upon termination of a certain type of activity by the organization. The norms of the Labor Code do not contain such a reason for the termination of the employment contract. And the current guarantees for the termination of an employment contract for certain categories of workers (women, persons with seminal duties) do not allow you to stop working with the employee in the current situation. As a result, there is an imbalance between the interests of the employee and the employer, since the rights of the employer are not provided in any way and he is forced to bear the costs of an employee who does not carry out work.
