INSTRUMENTAL ASPECTS OF THE STUDY ON LEGAL ESTABLISHMENT
Abstract
The article considers effective, legal and organizational impact on social relations
with the aim of their legal establishment. In favor of the legal establishment motivational
arguments are given. Being the main state law and therefore holding the leading position
in the national legal system, any constitution has specific legal properties that distinguish
it from others, both domestic and international legal acts. However, despite the significance
of priority, policy and universality of constitutional provisions, their direct force,
higher legal effect, a special order of acceptance (change) and protection of constitutional
norms, it is obvious that it’s not them, but meaningful characteristics of the constitutional
articles exert a priority influence on the maintenance of constitutional order. In this regard,
the importance of the constitution consists mainly in the fact that it establishes the most
common (universal) principles, rules and procedures that form the constitutional ideology
of relations of an individual, society and the state.
