GROUNDS AND CONDITIONS FOR INCCURENCE OF RESPONSIBILITY IN ENFORCEMENT PROCEEDINGS IN THE FORM OF ENFORCEMENT FEE COLLECTION

Abstract

The article focuses on the institution of enforcement fee. In legal literature, the legal
nature of the enforcement fee is one of the issues of dispute. The institution of enforcement
fee is insufficiently studied. The liability in the form of collecting the enforcement
fee for non-compliance with the requirements of the writ of enforcement within the time
limit set for its voluntary execution in enforcement proceedings requires the analysis of
causes and conditions of non-fulfillment of the writ of enforcement’s requirements by the
debtor. In this regard, the article suggest considering the content of the ground for bringing
to responsibility, as well as the conditions under which the official of the Bailiffs’
Service is entitled to make a decision on the use of such an enforcement measure as the
collection of enforcement fee.
