THE VALUE OF THE STRUCTURE IN THE STUDY OF THE SYSTEM OF LAW

Abstract

The article analyzes different points of view, developed in the legal literature on the relationship
between the concepts of "system of law" and "structure of law" in recent times.
The author, adhering to the system theory, proves the impossibility of terminology replacement
of these concepts, since the structure in relation to the system has an auxiliary character,
contributes to the notion of the system. The study of the system of law as required involves
the study of its structure and a systematic approach absorbs the structural one. "Nonequivalence"
of the concepts of system and structure of law is considered in the sense that
the category system of law includes the concept of its structure. Structure helps to integrate
and differentiate the content of the system by structural elements on the basis of certain criteria.
