INFLUENCE OF THE PRINCIPLE OF LEGAL CERTAINTY ON IMPLEMENTATION OF THE RULE OF PROGRESS OF CASE ON INSTANCES IN PRACTICE OF CASSATION COURTS
Abstract
In article practice of cassation courts is analyzed from the point of view of its compliance
to the principle of legal certainty and to the principle of broad freedom of appeal.
The conclusion on the lack of a uniform approach in application of legislative provisions
on progress of case on cassation instances that puts the participants of criminal legal proceedings
who are in similar situations in unequal position is made.
