IMPLEMENTATION OF CONSTITUTIONAL NORMS ON THE RIGHTS OF CITIZENS TO ACCESS TO JUSTICE IN CRIMINAL PROCEEDINGS
Abstract
In the article some aspects of implementation of constitutional norms on
creating conditions to provide the citizens’ access to justice are considered.
Special attention is paid to the enforcement of rights and interests of the
victims under criminal proceedings. The guarantees of victims’ rights areanalyzed under abeyance of pre-trial investigation and at decision making onsuspension of pre-trial investigation. Some propositions on the improvementof the victim’s legal status in a criminal trial are given. The copies of the procedural acts affecting the rights and interests of the victim shall be awarded to the victim. The decision on the termination of the criminal proceedings on the basis of non-rehabilitating grounds is possible only with the consent of the victim and after compensation for the harm caused by the crime. Participation of the lawyer who is a representative of the victim should be provided by the investigator, the investigator and the court in all cases when the victim seeks it.
