REPRESENTATION IN LEGAL PROCEEDINGS: COMPARATIVE LEGAL ANALYSIS
Abstract
As a result of the analysis of four types of legal proceedings (constitutional,
civil, criminal and administrative) the author notes that diversified standard
legal regulation of the institute of representation has essential differences. In
particular, the administrative legislation, unlike civil and criminal, establishes
obligatory higher legal education for the representative. The author considers
such position of the legislator to be right as it doesn't contradict the constitutional
guarantee to the rights to the qualified legal assistance. It proves the necessity
to use the unified approach to a regulation of the status of the representative
in all types of legal proceedings.
